Luc W. M. Mitchell

Luc W. M. Mitchell is an experienced litigator who represents institutional and individual investors in securities class actions and other shareholder litigation.  He has extensive experience litigating complex disputes from initial pleadings through every stage of trial and appellate proceedings.

Prior to joining Pomerantz, Luc represented both plaintiffs and defendants in complex commercial litigation and arbitration at an international law firm.  That experience provides him with insight into how corporations and their counsel evaluate and defend high-stakes shareholder and securities disputes.

Luc’s recent victories include:

• Secured a complete victory after a five-day bench trial in the Delaware Court of Chancery (affirmed on an en banc appeal to the Delaware Supreme Court) regarding a related-party transaction vetted by the Special Committee of the Board of a publicly traded financial company;
• Secured the return of a nine-figure mistaken wire payment on behalf of a financial-services client after a two-week bench trial and Second Circuit appeal; and
• Obtained favorable settlements on behalf of a major technology real-estate company in securities class-action and derivative suits;
• Obtained a nine-figure victory in an ICC arbitration regarding contracts in the oil & gas industry in Brazil;
• Obtained an eight-figure judgment for an international client in an HKIAC arbitration alleging breaches of contract by a Chinese company
• Obtained a substantial judgment (and defeated a dispositive counterclaim) for a Brazilian client in an ICC arbitration alleging breach of contract;
• Won reversal at the Seventh Circuit of a grant of summary judgment against client in pro bono appeal alleging Eighth Amendment violations;
• Won dismissal in the New York Commercial Division of a suit alleging fraud by cryptocurrency founders;

In his pro bono practice Luc handles criminal appellate work, including in capital and long-term incarceration cases.

Luc received his J.D. from Columbia Law School, where he was an editor on the Columbia Journal of European Law.  Prior to law school, he worked at the New York County District Attorney’s Office, and on a presidential campaign.  He received his B.A. from Sarah Lawrence College.
