A Client-Specific Approach
Pomerantz methodically evaluates possible claims by analyzing the strength of the claims and the potential for recovery:
Pomerantz works with our clients’ custodian banks to facilitate the claims filing process in class action settlements where the client chooses to participate. We provide custodian banks with a copy of Pomerantz’s monthly PomTrack® Report, which identifies all claims that a client should file and the pertinent deadlines. We also assist custodian banks to cure claims deficiencies identified by claims administrators. To facilitate this, the Firm has maintained long and successful relationships with the client relations teams of many of the largest U.S. custodian banks.
Once PomTrack® portfolio monitoring flags a potential claim, Pomerantz takes the following steps:
- Identify and assess the claim:
- Examine the underlying facts and applicable law to determine whether they support a viable securities case, analyzing the strength of the claims with input from our attorneys, forensic accountants, and investigators
- Quantify damages: Calculate the client’s losses tied to the misconduct
- Evaluate options and next steps: Based on the strength of the claims and potential recovery, Pomerantz advises clients on whether to:
- Seek Lead Plaintiff status in a securities class action
- File an individual action
